Southern California's Premier Injury Lawyers
HUNDREDS OF FIVE-STAR REVIEWS, MILLIONS OF DOLLARS RECOVERED
Every year, thousands of Southern California residents and visitors suffer from injuries or lose their lives in car accidents that were not their fault. According to the California Office of Traffic Safety, there were 4,285 traffic fatalities and 269,031 traffic injuries in the state in 2021. Southern California counties, such as Los Angeles, Orange, San Diego, San Bernardino, and Riverside, accounted for the majority of these crashes. Many factors, such as drunk or drugged driving, distracted driving, speeding, and weather conditions, contributed to these collisions. In fact, in 2021, 52.9% of all drivers killed in motor vehicle crashes who underwent testing were found positive for legal and/or illegal drugs. Alcohol-impaired driving fatalities (fatalities in crashes involving a driver or motorcycle rider with a blood alcohol concentration, or BAC, of 0.08 or higher) increased by 16% from 1,180 in 2020 to 1,370 in 2021.
For the survivors of these car accidents, the road to recovery is often long and difficult. They have to deal with the medical expenses, lost wages, property damage, and legal issues that result from the crash. They also have to cope with the physical and emotional trauma that can affect their quality of life. Some of them may face permanent disabilities, chronic pain, or psychological disorders. They may also encounter unexpected challenges, such as insurance denials, that can worsen their situation.
At Text Kevin Accident Attorneys, we understand the impact these accidents have on individuals and their families. Led by the compassionate and skilled Kevin Crockett, our team is committed to providing personalized legal support to each client.
Our firm’s success is evident in our impressive track record, featuring substantial settlements and verdicts across a spectrum of personal injury cases. From securing $2.75 million for a rideshare driver involved in a severe collision to achieving a $1.25 million settlement in a complex pedestrian accident, we’ve demonstrated our commitment to justice and client welfare.
With multiple offices across California, including Irvine, Palm Springs, Indio, Moreno Valley, Santa Ana, Anaheim, and Norwalk, we provide comprehensive coverage for our clients. If you’ve been injured in a car accident in Southern California, we’re here to help.
What Is California Personal Injury Law?
Personal injury law is an area of civil law that allows injured parties to file legal claims and lawsuits against those who are responsible for causing their harm. This includes claims against people whose negligent, reckless, or intentional acts or omissions led to the victim’s injuries. In California, personal injury law is governed by the California Civil Code, the California Code of Civil Procedure, and the California Evidence Code, as well as by case law and jury instructions.
One of the most common types of personal injury claims is based on negligence. Negligence is the failure to use reasonable care to prevent harm to oneself or to others.
To prove negligence, the injured party (the plaintiff) must show the following elements:
- The at-fault party (the defendant) owed a duty of care to the plaintiff. The duty of care owed depends on the type of case and the relationship between the parties. For example, the duty of care owed in an auto accident case would typically be driving as a reasonable person would drive under the same or similar circumstances. This duty is established by the California Vehicle Code, which sets forth the rules of the road for drivers.
- There was a breach of this duty of care. A breach occurs when the defendant fails to meet the standard of care that is expected of them in the situation. Examples would include a driver who chose to exceed the speed limit, run a red light, or text while driving.
- The breach in the duty of care caused the plaintiff’s injuries. Causation is the link between the defendant’s breach and the plaintiff’s harm. The plaintiff must show that the defendant’s breach was a substantial factor in bringing about the injury. This means that the injury would not have occurred without the defendant’s breach or that the breach made the injury more likely or more severe. Causation can be established by direct or circumstantial evidence, such as eyewitness testimony, medical records, or accident reconstruction.
- The plaintiff suffered damages as a result of the defendant’s negligence. Damages are the losses or harms that the plaintiff experienced because of the injury. Damages can be economic, such as medical expenses, lost income, or property damage, or non-economic, such as pain and suffering, emotional distress, or loss of enjoyment of life. The plaintiff must prove the amount and extent of their damages with reasonable certainty. Damages can be recovered by filing a claim with the defendant’s insurance company or by filing a lawsuit in court.
In California, personal injury law follows the comparative negligence rule, which means that the injured person’s compensation can be reduced in proportion to their percentage of fault. If the injured individual is found to be more than 50% at fault for the incident, they may be barred from recovering any damages. The comparative negligence rule is codified in California Civil Code section 1714.
Personal injury cases in California are subject to certain time limits, known as statutes of limitations. These are deadlines for filing a lawsuit in court after an injury occurs. The general statute of limitations for personal injury cases in California is two years from the date of the injury, according to California Code of Civil Procedure section 335.1. However, there are some exceptions and variations depending on the type of case and the defendant involved. For example, the statute of limitations for suing a public entity or employee is six months from the date of the injury, according to California Government Code section 911.2. If the plaintiff misses the statute of limitations deadline, they may lose their right to sue and recover damages.
Personal injury law in California is a complex and evolving field that requires the knowledge and skill of an experienced attorney. If you have been injured by someone else’s negligence or wrongdoing, you should consult with Text Kevin Accident Attorneys as soon as possible to protect your rights and interests.
Potential Compensation for Car Accident Injuries in Southern California
If you have been injured in a car accident in Southern California, you may be entitled to several types of compensation from the party who caused your harm. At Text Kevin Accident Attorneys, our experienced California car accident lawyers can help you pursue the full and fair recovery you deserve.
Some of the damages you may claim in a personal injury lawsuit include:
- Medical Expenses: You can seek reimbursement for the costs of your medical care, such as ambulance fees, emergency room visits, diagnostic tests, surgeries, hospital stays, medications, physical therapy, rehabilitation, and any other treatments you need for your injuries. You can also claim compensation for the costs of any medical devices, equipment, or home modifications that you require, such as wheelchairs, crutches, prosthetics, stair lifts, or ramps.
- Lost Income: You can recover the income you lost due to your inability to work or attend work-related appointments because of your injuries. You can also claim compensation for the loss of your future earning potential if your injuries affect your ability to work in the same capacity or profession as before the accident.
- Property Damage: You can seek compensation for the damage to your vehicle or any other property that was involved in the accident. You can claim the costs of repairing or replacing your property, as well as the diminished value of your vehicle if it has suffered permanent damage.
- Pain and Suffering: You can seek compensation for the physical and emotional pain and suffering you endured as a result of the accident and your injuries. This includes the impact of your injuries on your mental health, well-being, and quality of life.
- Loss of Enjoyment: You can seek compensation for the loss of your ability to enjoy your hobbies, interests, or activities that you used to do before the accident. This includes the loss of your pleasure, happiness, or satisfaction in life.
- Loss of Consortium: Your spouse can seek compensation for the loss of your companionship, affection, or intimacy due to your injuries. This includes the loss of your marital relationship, support, or services.
- Punitive Damages: In some cases, you may be able to seek punitive damages from the party who caused your harm. Punitive damages are not meant to compensate you but to punish the defendant and deter them and others from engaging in similar conduct in the future. Punitive damages are only awarded in cases where the defendant acted with malice, oppression, or fraud, which means they acted with intent to harm, extreme recklessness, or deceit.

California Car Accident FAQ
A car accident can be a devastating event that leaves you with serious injuries and damages. You may have questions about your legal options to seek compensation for your losses. We have answers. Here are some of the most frequently asked questions we get from clients and potential clients. To learn more about any of these topics, contact a California car accident lawyer at Text Kevin Accident Attorneys today.
Who Is Responsible for My Car Accident?
This is one of the most common questions we get. The answer is: It depends. In general, anyone who causes a car accident in California by acting negligently, recklessly, or intentionally can be held liable for the injuries and damages they cause. However, the specific parties who may be responsible for your car accident vary depending on the circumstances of your case.
For example, in many car accidents, the other driver is at fault because they were speeding, distracted, impaired, or violated a traffic law. In such cases, you can pursue a claim against the other driver and their insurance company.
However, the other driver may not be the only one who is liable for your car accident. Suppose the other driver was working for a company and driving a company vehicle when they hit you. In that case, you may also have a claim against the driver’s employer under the theory of vicarious liability.
Or imagine the other driver lost control of their car because of a defective tire that blew out. In that situation, you may have a claim against the tire manufacturer, the seller, or the installer under the theory of product liability.
In short, every car accident case is unique. To find out who may be liable for your car accident and the injuries you suffered, you need to consult with an experienced California car accident lawyer.
How Much Compensation Can I Get for My Car Accident?
Again, it depends. Every car accident case is different, not only in terms of who is liable but also in terms of how much compensation you may be entitled to.
Many factors affect the amount of damages you can recover through a legal claim, such as:
- The Severity of Your Injuries: Generally speaking, the more serious your injuries, the more compensation you may receive as damages. Your age and health before your car accident are also relevant factors to consider. Generally speaking, damages are higher for younger and healthier people than for older, less healthy people (though that is not always the case).
- How Much Your Car Accident Has Affected Your Life: The more your car accident impacted your life—in terms of the time it took to heal and how it affected your daily activities—the more potential damages you may have (usually).
- The Number of Parties Who Are Liable for Your Car Accident: You may have a better chance of obtaining maximum damages if multiple parties are liable for your car accident than if only one person or entity is. The financial resources available to pay damages is yet another relevant factor to consider. Realistically, a car accident claim is only worth as much money as there is to pay it. So, if the party or parties liable for your car accident have adequate insurance or assets, your claim will have a higher value than if they have little or no insurance and no assets.
These are just some of the factors that influence how much money you can get for your car accident. To learn more about how much you may recover in your specific case, talk to a skilled California car accident lawyer.
How Much Does a California Car Accident Lawyer Cost Me?
In most cases, nothing unless you win your case and receive compensation for your injuries and damages. Car accident lawyers typically work on a contingency fee basis, which means that they only get paid a percentage of the recovery if they successfully recover money for you. This also means that they cover the upfront costs of the case, such as filing fees, expert fees, and investigation expenses.
You don’t have to pay anything out of pocket to hire a car accident lawyer. You should always discuss the fee arrangement with any lawyer you consider hiring for your car accident case, though.
How Long Does a Car Accident Case Take?
It depends. Every car accident case is different and involves several factors that affect the duration of the case.
Some of these factors include the complexity of the case, the number of parties involved, the amount of damages claimed, and the willingness of the parties to negotiate or litigate. Some cases can be settled in a matter of weeks, and others take years to resolve.
The important thing to remember is that you are always in charge of your case. Your lawyer will advise you on the best course of action, but you make the final decisions, including whether to accept a settlement offer or go to trial.
I Need Money Now, and the Insurance Company Just Offered Me a Settlement. Should I Take It?
This is one of the most difficult questions we face. We understand that car accidents can cause financial hardship for victims and their families. You may have mounting medical bills, lost income, and other expenses that you need to pay. The insurance company may try to take advantage of your situation and offer you a lowball settlement that does not reflect the true value of your case.
Be wary of any offer from the insurance company without consulting with a car accident lawyer first. Accepting a settlement from the insurance company means giving up your right to sue for more money later. You may end up with less than you deserve and need.
Our California car accident lawyers can help you evaluate the offer and negotiate for a fair and full settlement that covers all your losses.
Do I Really Need a Car Accident Lawyer for My Case?
Some of our clients are confident and assertive. They have some experience in dealing with insurance companies and think they can handle their own car accident claim. They wonder: “Why should I hire a lawyer? Can’t I just negotiate with the insurance adjuster or the other driver’s lawyer by myself?”
We strongly advise against handling your car accident claim on your own. In our years of practice, we have almost never seen a car accident victim who represented themselves get the best possible outcome for their case. There are two main reasons why.
First, evaluating the value of a car accident claim requires a thorough knowledge of the facts and the law related to your injury. You may know the facts better than anyone (although some people may overlook some crucial details), but chances are you don’t know the legal issues that affect how much money you deserve. That puts you at a huge disadvantage compared to the lawyers and insurance companies on the other side.
Second, as a practical matter, large corporations are unlikely to respect you without an experienced car accident lawyer on your side. Lawyers and insurance companies will immediately downplay the seriousness and worth of your claim. They will assume (most likely, correctly) that you lack the legal skills, courtroom experience, and procedural knowledge to enforce your rights in court. As a result, your chances of getting anything close to the amount of money you truly need will drop to almost zero.
The bottom line is to hire a lawyer. In most cases, lawyers more than pay for themselves and give you peace of mind as well.
How Do I Find the Best Car Accident Lawyer for My Case?
Nowadays, the internet makes it easy to find a lawyer. However, when it comes to getting the maximum compensation for your injury, you want to find a lawyer with the talent and experience to get you the most money possible for your specific situation.
How do you find a lawyer who is the perfect match for you? Look for a lawyer who has a long history of success and who can show you specific examples of representing clients who got injured the same way you did and suffered the same kinds of injuries you have. (Keep in mind, however, that no lawyer can guarantee you a certain outcome, and no ethical lawyer would ever claim otherwise.) In other words, do not jeopardize your physical and financial recovery on an inexperienced attorney.
Look, too, for an attorney who has the resources to meet your needs. Is the lawyer you are considering a solo practitioner, or can you tell the lawyer has the support of a skilled team to help ensure your case stays on track?
Does the lawyer work with a network of investigators and experts in areas relevant to your case? These resources matter—they can make the difference between a winning case and a case that never reaches the finish line.
When Should I Contact a Car Accident Lawyer for My Injury?
We are biased, of course, but in our experience, clients get the best results when they contact a lawyer as soon as possible after suffering an unexpected, accidental injury because of someone else’s actions. With every day that passes after an injury, evidence disappears, witness memories fade, and it becomes harder and harder to build the strongest possible case for compensation.
We understand the practical limitations of this advice: sometimes, an accident or incident leaves you hospitalized and unable to seek legal help. However, you have the best chance of success in a car accident claim if you (or a family member) call a lawyer as soon as it is possible to do so.
What Can I Do to Maximize My Car Accident Compensation?
First and foremost, get well. See a doctor as soon as possible, follow the doctor’s instructions, and focus on your health until you fully recover. Getting the medical care you need not only protects your physical and emotional health but also strengthens your legal rights. Every doctor visit creates important medical records that a lawyer can use to show someone’s legal responsibility for your injury and the amount of damages you need.
Next, as we’ve said, contacting a California car accident lawyer as soon as possible helps put you in the best situation to recover the most money possible under the law.
Also, as we’ve said, staying away from insurance companies and letting your lawyer handle the communication with them preserves your rights.
Finally, though this may seem trivial, staying off social media benefits you. In this era, people try to show their best lives online. The problem we have discovered is that the shiny, happy version of your life you post on social media can reduce the value of your car accident claim. Insurance investigators and defense lawyers may use what you say in posts to portray your injury as not so severe. Do not make the error of compromising your rights. Keep your social media use to a minimum, or better yet, avoid it completely until you have talked to your lawyer.
